1. TRUMP SIGNS ORDER TO END BIRTHRIGHT CITIZENSHIP

Latest immigration news is a real jaw-dropper. On the first day of his Presidency, President Donald Trump signed an executive order ending birthright citizenship for children born in the U.S. to non-citizens or those on temporary visas. That means kiddos born to parents here on student, work, or visitor visas would no longer automatically become U.S. citizens. For decades, if you were born on American soil, you were in. Full stop. But now? Not so fast. The new rule is set to kick in on February 20.

Why does this matter? For over 150 years, the 14th Amendment has been interpreted to mean that if you’re born in the U.S., you’re a citizen—no questions asked. But there’s a key phrase in that law:

ā€œā€¦and subject to the jurisdiction [legal authority] thereofā€¦ā€

Trump’s team argues that not all non-citizens are fully under U.S. legal authority, so their kids shouldn’t automatically become citizens. That’s the reason behind this order—not just a general effort to ā€œprotect the meaning of citizenship.ā€

The move has sparked MAJOR backlash. Within hours, over 22 states and groups like the ACLU and NAACP filed lawsuits, claiming the order violates the Constitution. The ACLU didn’t mince words, calling it ā€œblatantly unconstitutional.ā€ Legal experts expect this fight to head straight to the Supreme Court. āš–ļø

Supporters of the order argue it’s a necessary step to stop ā€œbirth tourismā€ and tighten immigration policies. Critics say it’ll create massive legal headaches and leave countless families in limbo. But, no matter where you stand, this move is poised to reshape the lives of families all over the world.

2. WHAT IS ADJUSTMENT OF STATUS (AOS) AND HOW DOES IT WORK?

Adjustment of Status (AOS) is a process that allows eligible individuals who are already in the U.S. on a valid visa to apply for a Green Card without having to travel back to their home country. Pretty convenient, right?

To qualify for AOS, you need to meet certain criteria:

  • 1ļøāƒ£ You must be physically present in the U.S.  

  • 2ļøāƒ£ You should have entered the country legally, i.e., with a valid visa or parole. 

  • 3ļøāƒ£ You must meet the criteria for the immigration category you’re applying under.  For example, if you’re applying for EB-2 NIW, your self-petition (Form I-140) must already be approved or submitted concurrently with your AOS application.

  • 4ļøāƒ£ You must not have any major immigration violations, such as overstaying your visa or working without authorization.

If you meet these criteria, filing Form I-485 is the next step to get the ball rolling.

You can include your spouse and unmarried children under 21 in your AOS application. However, you can’t include your parents, grandparents, or siblings. And honestly, that’s it—no one else qualifies!

Each eligible family member will need to submit their own AOS package and pay the required fees individually. Be sure to prepare documents that prove your relationships, like marriage or birth certificates.
